General Principles & Relevant Legislation
1.Trade samples’ means animal by-products or derived products intended for particular studies or analyses authorised by the competent authority in accordance with Article 17(1) of Regulation (EC) No 1069/2009 with a view to carrying out a production process, including the processing of animal by-products or derived products, the development of feedingstuff, pet food or derived products, or the testing of machinery or equipment; under Commission Regulation (EC) no. 142/2011.
2. The importation of products of animal origin such as Trade Samples from third countries is prohibited unless authorised in advance by a licence issued by the Department of Agriculture, Food and the Marine. The Trade Samples licence issued by the Department of Agriculture, Food & Marine is referred to as a Vet17 licence. Please see below Licence Application Forms and supporting documents.
3. In addition to the Vet17 licence requirement, the import of Trade samples from third countries will also require a Trade Sample Health Certificate. The appropriate health certificate model required for Trade sample products is Chapter 8 Health Cert model as listed in Annex XV of Commission regulation EC no. 142/2011. . 4. Regulation (EC) No 1069/2009 lays down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No1774/2002 (Animal By-Products Regulation).

Important:
Products of animal origin that do not comply with import conditions and controls can be seized either for destruction or return to the country of origin at the importers expense.
The import licence referred to below is issued without prejudice to import controls that may be required other than for public or animal health reasons and does not exempt importers from any prohibition, regulation or restriction imposed by any other agency or department
Useful definitions
1. ‘Animal by-products’ means entire bodies or parts of animals, products of animal origin or other products obtained from animals, which are not intended for human consumption, including oocytes, embryos and semen.
2. ‘Derived products’ means products obtained from one or more treatments, transformations or steps of processing of animal by- products.
3. ‘Operator’ means the natural or legal persons having an animal by- product or derived product under their actual control, including carriers, traders and users.
4. ‘User’ means the natural or legal persons using animal by-products and derived products for special feeding purposes, for research or for other specific purposes.
5. ‘Establishment’ or ‘Plant’ means any place where any operation involving the handling of animal by-products or derived products is carried out, other than a fishing vessel.
6. ‘Certificate of Registration’ , also referred to as the CoR. The Certificate of Registration is issued by Animal by Products Division. All establishments receiving animal by products and or derived products must be registered with ABP division, the establishment must obtain a Certificate of Registration (CoR).
Registration of Establishments
1. An establishment receiving animal by-products and/or derived products as Trade Samples must be registered by the Department of Agriculture, Food and the Marine.
2. Furthermore, the registration must be in date as detailed in Article 23 of Regulation (EC) No 1069/2009.
3. Application for registration of an establishment should be made to the Animal By Product division;

A copy of the Certificate of Registration (CoR) issued by the Animal By-Products section, listing the Trade Sample product, must accompany the Vet17 application.
Vet17 License Application
1. Application forms for a VET 17 licence must be completed by the operator, as per the Certificate of Registration. The Vet17 licence will be valid per consignment detailed in the application form submitted. Please note that a Vet17 licence is not an annual licence.
2. Application forms are available in the section entitled ‘Application Forms and Supporting Documentation’ below.
3. The original completed Vet17 application form, signed by the operator as per the Certificate of Registration (CoR), issued by Animal By Product Division together with a copy of the Certificate of Registration(CoR) issue by ABP division, should be submitted along with a copy of the Certificate of Registration, to Animal Product imports to the address as listed below, not less than 7 working days before the intended date of import.

4. To expedite the processing of an application form for a VET 17 Trade Sample licence, please e-mail a scanned copy of the application form completed and signed by the operator as listed on the Certificate of Registration (CoR), along with a scanned copy of the Certificate of Registration to: AnimalProductImports@agriculture.gov.ie
5. However, the licence will not be issued until the original signed application form has been received by post. Please post to Animal Product Imports to the address indicated above.
Import conditions for Trade Samples Not for Human Consumption
(1) This import is for Trade Samples only and not for re-sale.
(2) The consignment must be imported through a designated point of entry - either Shannon Airport or Dublin Airport
(3) The competent authority may authorise the import and transit of trade samples, provided that they originate from:
(a) (i) third countries referred to in the column ‘third countries’ list of row 14 table 2 of section 1 of Chapter II on this Annex XIV of Commission Regulation (EU) No 142/2011.
(ii) in the case of trade samples which consist of milk, milk-based products or milk derived products, authorised third countries listed in Annex I to Regulation (EU) No 605/2010;
(b) They are accompanied by a health certificate as referred to in Chapter 8 Annex XV of Commission regulation EC no. 142/2011.
(c) And following the veterinary checks provided for in Directive 97/78/EC and in accordance with the conditions laid down in Article 8(4) of that Directive, they are transported directly to the approved or registered establishment or plant indicated in the authorisation of the competent authority.
(4) The consignment must bear a label with the following words visibly and legibly displayed “Trade sample not for human consumption”.
(5) Each consignment must be accompanied by:
a. A copy of the Vet17 licence as issued by the Department of Agriculture Food & Marine.
b. An original signed Chapter 8 Health Certificate as per Annex XV of Commission regulation EC no. 142/2011
c. An original signed commercial document in accordance with the Annex I Model.
(6) A copy of the Vet17 licence, the official Chapter 8 health certificate and the Annex I commercial document must be transmitted by the clearing agent to the BCP of entry, along with the MRN number of the consignment, upon arrival of the consignment to facilitate its clearance from Customs. (7) The consignment, if requested, must be made available for examination by an officer of the Department of Agriculture, Food and the Marine at the authorised point of entry.

(9) Users that handle Trade Samples shall take all necessary measures to avoid the spreading of diseases communicable to humans or animals during the handling of the materials under their control.
(10)The consignment must be transported in accordance with IATA and ADR Regulations and travel directly from the authorised point of entry to the destination addresses provided in the licence application.
(11) Unless trade samples are kept for reference purposes, they shall be (a) redispatched to the third country of origin (b) dispatched to another Member State or third country, if such dispatch has been authorised by the competent authority of the Member State or third country of destination in advance or (c) disposed of or used in accordance with Article 12 ,13 &14 Regulation (EC) No 1069/2009.
(12) If at any time the conditions of the licence cannot be met or any unlicensed substance is discovered in the imported material the facts must be reported at once to DAFM.

(13) This licence is valid for the importation of the Trade Sample as listed and will unless previously suspended or revoked by the said Minister; continue in force until the validity date stated. This import licence is issued without prejudice to import controls that may be required other than for public or animal health reasons.
Samples from EU member States and Northern Ireland
1. There is no requirement for a VET 17 import licence in relation to the movement of Trade Samples between EU Member States.
2. Trade Samples from Andorra, Channel Islands, Isle of Man, Faeroe Islands, Iceland, Liechtenstein, Norway, San Marino and Switzerland may also be imported without a VET 17 import licence.
3.Currently under the Northern Ireland protocol agreement, trade samples from Northern Ireland do not require a Vet17 licence for import.
