Proposed Data Sharing Agreement between the Department of Housing, Local Government and Heritage and the National Museum of Ireland (DSA for Consents for National Monument Works Data)

The Data Sharing and Governance Act Framework for sharing data builds upon the Data Sharing and Governance Act 2019 (DSGA) by setting out a common set of practices for all Public Bodies to follow when they wish to use the Act as their legal basis for sharing data. Under the Framework, data sharing agreements between public bodies for the purpose of sharing personal data will be made available for public consultation for a period of 28 days.

The Department of Housing, Local Government and Heritage intends to enter into a Data Sharing Agreement under the DSGA with the National Museum of Ireland in advance of issuing Consents for works to a national monument. The Director of the National Museum of Ireland is a statutory consultee in relation to Ministerial Consents, as provided under section 14 of the National Monuments Act 1930 as amended by section 5 of the National Monuments (Amendment) Act 2004.

This Data Sharing Agreement covers sharing of Personal Data, in limited circumstances, by the Department of Housing, Local Government and Heritage with the National Museum of Ireland. The data sharing activity may include such personal data elements as names, addresses and contact details of the applicant and of the landowner; purpose and description of proposed works.

The start date for public consultation is 28 September 2022 and will run for a period of 28 days. The public consultation will end on 26 October 2022. Submissions will not be accepted once the public consultation period has expired.

We will consider your submission and may respond. Where the proposed parties consider it appropriate, they may also amend the proposed agreement to take into account your submissions. A copy of the Data Sharing Agreement and a summary of all submissions will be sent to the Data Governance Board.
