Commission of Investigation (Irish Bank Resolution Corporation) Act 2016

The Commission of Investigation into transactions and activities of the Irish Bank Resolution Corporation was established in June 2015. The first Interim Report of the Commission published in November 2015 outlined a number of issues which had arisen in the course of the Commission's work, including:

  • the Commission’s determination that the issue of confidentiality precluded it from admitting documents into evidence
  • the Commission’s determination that the issue of legal privilege precluded it from admitting documents into evidence
  • the Commission’s determination that the duty of professional secrecy under section 118 of the Companies Act 1990 precluded it from admitting documents into evidence
  • potential conflicts of interest and the appointment of additional member(s) to the Commission

This Act introduces legislation which addresses the issues raised in the report and enables the Commission to effectively conduct its investigation.
