Data Governance Board – Data Sharing Agreement Register



Background

The Data Sharing and Governance Act 2019 (DSGA) introduces a layer of governance and transparency to the sharing of personal information between Public Service Bodies. Governance is applied through the oversight of the Data Governance Board, who, as set out in the DSGA, must review each data sharing agreement having given regard to the matters as set out in Section (57).


The DSGA Data Sharing Agreement Register

This DSGA Data Sharing Agreement Register (the Register) fulfils the obligation under Section 60(5) of the DSGA, which sets out that the Data Governance Board (the Board) shall publish a copy of the Data Sharing Agreement (DSA) including the summarised Data Protection Impact Assessment, if conducted; and a copy of the Board recommendations.

The Register contains details of all DSAs that have successfully completed the processes set out in the DSGA Data Sharing Playbook, and have used the DSGA Model Data Sharing Agreement Template. Key processes completed include a 28 day period of Item was unpublished or removed the review of each agreement by the Board and resulting recommendations being adopted by the parties to that agreement.

The Data Governance Unit provides Secretariat support for the Data Governance Board under the DSGA, and maintains this Register on behalf of the Board.

The DSGA Data Sharing Playbook and Model DSA Template are a part of a wider Data Sharing Governance Framework, which was developed to guide public bodies through the data sharing process under the legislation. The layer of governance applied by the Data Sharing Governance Framework and the oversight applied by the Board ensures greater transparency in the way that data is shared by public bodies, and that the recommendations for each reviewed DSA reflect the interests of the public.
