Government Appointments to the Court of Appeal

At its meeting today, the Government nominated The Hon Ms. Justice Caroline Costello, Judge of the High Court for appointment by the President to the Court of Appeal.
The Government also agreed, in principle, to nominate The Hon Ms. Justice Isobel Kennedy, Judge of the High Court, for appointment by the President to the Court of Appeal, once a vacancy arises in that Court following the retirement of The Hon. Mr. Justice John Hedigan later this month.
The existing vacancy in the Court of Appeal arises from the retirement of The Hon Mr Justice Gerard Hogan on 6 October 2018 in order to take up his new role as an Advocate General of the Court of Justice of the European Union.
The Government has taken the necessary steps to formally advise President Higgins of the nominations in accordance with constitutional procedure.
Section 17 of the Court and Court Officers Act 1995 provides that where the Government proposes to advise the President to appoint a serving Judge, the provisions of Section 16 do not apply (i.e. the submission of names of suitable candidates by Judicial Appointments Advisory Board).
