Tánaiste establishes Tribunal of Inquiry

Tánaiste and Minister for Defence Micheál Martin today formally launched a Tribunal of Inquiry to examine the Defence Forces complaints process in relation to bullying, discrimination, harassment and sexual misconduct.
The inquiry chaired by Ms Justice Ann Power, a key recommendation of the Independent Review Group report, was formally established by Statutory Instrument and will begin its work imminently.
The Tánaiste said:
“The establishment of this Tribunal of Inquiry, along with increased levels of investment, is another important step in the renewal of our Defence Forces as a rewarding career where every individual feels valued.
“Following approval of the Terms of Reference by both Houses of the Oireachtas, the Statutory Instrument I signed today now formally establishes the Tribunal.
“I want to wish the Honourable Ms Justice Ann Power every success in her role as Chair and I look forward to the Tribunal issuing its guidance for anyone who wishes to take part in this important process.”
The Tribunal of Inquiry will examine the effectiveness of the complaints processes in the Defence Forces concerning workplace issues relating to discrimination, bullying, harassment, sexual harassment and sexual misconduct.
It will also have the power to investigate the response to complaints made regarding the use of hazardous chemicals within Air Corps’ headquarters at Casement Aerodrome, Baldonnel.
The Independent Review Group which was established in 2022 recommended the establishment of a statutory fact-finding process. This has now been established through this Tribunal of Inquiry.
In January 2022, a Judge-led Independent Review was established to examine dignity and equality issues in the Defence Forces. The report of the Independent Review Group (IRG) was published following government approval on 28 March 2023. The government agreed to progress the recommendations contained in the Report.
Draft Terms of Reference for a Statutory Inquiry were prepared in consultation with the Attorney General and developed based on feedback received from a wide variety of interested parties.
In January this year, the government appointed Ms Justice Ann Power to Chair the Tribunal of Inquiry and its Terms of Reference were also subsequently approved by resolutions of both Dáil Éireann and Seanad Éireann.
The Inquiry is being established pursuant to the provisions of the Tribunals of Inquiry (Evidence) Act 1921 (as amended).
The Tribunal will be based in Infinity Buildings, Infinity Building, George’s Court, George’s Lane, Smithfield, Dublin 7, DO7 E98Y.
