The Applicant, [ ] was attacked on the night of the [ ] by a party known to him and another at his home at [ ].
He was stabbed several times, [ ].
He has an ongoing requirement for [ ] and has submitted several receipts for [ ] for prescriptions and for [ ].
The attack on the Applicant was perpetrated by [ ] for whom the Applicant had been working as a drug dealer. In his statement to An Garda Síochána, he has stated that "the first time [ ] came for a pup [ ] was with him. That was the start of my dealings with [ ]. [ ] would drop the weed, hash and tablets to my house and road at the start. Later on, I would have to go to [ ] to collect the weed, hash and tablets".
The Applicant specifically stated "I was selling for [ ] for a couple of months. I used to get a half kilo of weed off [ ] about every four weeks. I used to get that on tick. I used to get Valium tablets off him aswell. [ ] would come to me every week to collect money off me. [ ] would often call to my house at [ ] to collect money for the drugs he gave me. I would sell hash and tablets for [ ] when I collected money for the drugs I sold, [ ] would call to my house and I would pay him for the drugs he gave me."
The Applicant has fifteen previous convictions dating from [ ] which include "possession of drugs for the purpose of sale or supply, unlawful possession of drugs, public order, assault and attempted robbery".
Article 14 of the Scheme for Criminal Injuries provides "no compensation will be payable where the Tribunal is satisfied that the conduct of the victim, his character or his way of life make it inappropriate that he should be granted an award and the Tribunal may reduce the amount of an award where in its opinion it is appropriate to do so having regard to the conduct, character or way of life of the victim".
Taking all the foregoing into consideration, the Tribunal is satisfied that Article 14 of the Scheme applies in this instance and accordingly the Tribunal dismisses the application and makes no award.
