1. Mr [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. On the night of the [ ], the applicant claims that he was the victim of an unprovoked shooting incident while walking to his girlfriend’s house. He was shot in the [ ] by a lone gunman (“offender”).
3. The applicant sustained (non-life threatening) injuries to his abdomen. The applicant was treated in [ ] Hospital.
4. The incident was reported to and investigated by [ ] Garda Station. The Tribunal has not been advised if the offender was ever formally charged or prosecuted.
5. The applicant claims that he was out of work at the time he made the application to the Scheme. However, he has failed to vouch and prove that he actually incurred any out-of-pocket expenses.
6. No contact has been received by the Tribunal for or on behalf of the applicant for over 17 years. The Tribunal wrote to the applicant on the [ ] enquiring whether he wished to advance his application. He was invited to vouch any losses for out-of-pocket expenses. The applicant was further advised that the file would be sent to a member for consideration by a member of the Tribunal if no response was forthcoming by [ ]. No response was received from the applicant to this correspondence.
7. Unfortunately, it is not within the remit of the Tribunal to award compensation for pain and suffering. The Tribunal also cannot make awards in respect of estimated expenses. The applicant has failed to vouch and prove that he incurred any out-of-pocket expenses. Regrettably, in such circumstances, it is not possible to make any award to the applicant.
