The Tribunal received a completed application form in respect of this incident on the [ ] [ ].
The Applicant claims that he was the victim of a physical assault at [ ] on the [ ].
The claim was received by the Tribunal outside of the three month time limit for the bringing of claims under the Scheme as laid down by Article 21 of the Scheme. In his response at section 2(f) of the application form the Applicant states: -
"Claimant was awaiting receipt of loss of earnings certificate from his employer [ ] for a number of months despite repeated reminders. The details of loss of earnings were obtained in [ ]. "
It is not clear why the Applicant unfortunately did not submit the application within the three month time limit and forward the loss of earnings certificate at a later date once it was to hand.
As such, there appears to be no circumstances which are determined by the Tribunal to justify exceptional treatment of this late application.
The Tribunal is not satisfied that the claim falls within the ambit of the Scheme and therefore the Applicant is not entitled to be compensated pursuant to the provisions of the Scheme.
