On the [ ] the Applicant was sitting in his girlfriend’s car with his girlfiend when the passenger door opened and the perpetrator punched him in the eye. The Applicant sustained injuries to his left eye. The perpetrator [ ] soon after the incident and the Applicant received no compensation in respect of the incident. The Applicant attended Dr. [ ] in [ ], [ ] for treatment and also attended [ ] Hospital. On the date of the incident the Applicant was on social welfare. The Applicant submitted that he incurred expenses of €16 in respect of the incident.
Pursuant to paragraph 19 of the Criminal Injuries Compensation Scheme an applicant must make their application within three months of the date of the incident. The application was received outside the three month time limit provided for under the Scheme and no circumstances were outlined that would justify exceptional treatment so as to extend the time. Further, the Applicant’s application does not contain any evidence of special damages incurred by the Applicant in respect of the incident. In the circumstances the Tribunal makes no award in this instance.
