Article 21 of the Scheme provides that:
"Application should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury. In the case of an injury arising outside the event which took place before the commencement of this action, the application must be made not later than three months from the date of the commencement (subject, also, to the foregoing exception)."
At Section 2F of the application form, the applicant alleges:
"I was unaware of entitlement to claim and have heart medical issues which require my attention."
The Applicant claims he was injured when he fell to the ground [ ] [ ], which was being driven away by an unidentified person after the Applicant got out of his vehicle to speak to another unidentified person [ ] [ ] no criminal prosecution was initiated, as set out in the report of Garda [ ] dated [ ] [ ].
The Application is not within the time period provided for in Article 21 of the scheme and the grounds put forward by the Applicant at 2.f of the Application do not warrant exceptional treatment and on foot of same I refuse the Application.
