On the [ ] the Applicant was entering his house when he was kicked to the ground by someone behind him. He fell onto the corner of the step to his house and injured his arm. At that point three young men turned him over and searched his pockets. Two men from across the street ran over to assist him and the three young attackers ran away. The Applicant was in a lot of pain following the incident and he was told he had a broken arm and broken ribs. The Applicant submitted a note handwritten from the Commercial Manager at [ ] Limited confirming that he was offered employment that was due to start on [ ] after returning from [ ]. The note confirms that the Commercial Manager had employed the Applicant in [ ] in the past, and that his average wage after tax would have been in the region of €750. The Criminal Injuries Compensation Tribunal contacted An Garda Síochána and asked for a written statement in respect of the incident. That letter was sent on the [ ]. The Garda Síochána responded by letter dated the [ ] and stated that they had carried out extensive inquiries with all personnel to locate a record of the incident with no success. The Applicant was requested by letter dated the [ ] to submit all information in regard to social welfare benefit that he was in receipt of as a result of the incident and details of his employment history for the past three years prior to the incident. The Applicant did not submit any details in relation to his earnings prior to the incident or any details in relation to social welfare benefit received as a result of the incident. By letter dated the [ ] the Tribunal wrote to the Applicant and asked the Applicant to include all original receipts and vouching documentation in respect of the claim and informed the Applicant that if the Tribunal did not hear from the Applicant by the [ ] the file would be sent to a member for a decision. In circumstances where the Applicant has not submitted any vouching documentation in respect of his earnings prior to the incident in [ ] or in [ ] and has failed to submit any information in respect of social welfare received after the incident the Tribunal makes no award.
