The Tribunal received a completed application form in respect of this claim on the [ ] [ ] from the Applicant, having been notified by the Applicant of her intention to submit an application on the [ ].
The Applicant claims that she was the victim of a physical assault at [ ] [ ] on the [ ].
The claim was received by the Tribunal outside of the three month time limit for the bringing of claims under the Scheme as laid down by Article 21 of the Scheme. In his response at section 2(f) of the application form the Applicant states: -
"Forms have gone missing. This is my second application. Thanks."
It is not clear whether the Applicant is asserting that she submitted the application within the three month time limit and that the application went missing in the Tribunal office or whether she obtained a form and it went missing before she could submit it.
As such, there appears to be no circumstances as would give rise to circumstances which are determined by the Tribunal to justify exceptional treatment of this late application.
The Tribunal is not satisfied that the claim falls within the ambit of the Scheme and therefore the Applicant is not entitled to be compensated pursuant to the provisions of the Scheme.
