Date the Tribunal was notified: Tribunal was notified on the [ ] and therefore outside the time period set out in Article 21 of the scheme.
Article 21 of the scheme states:
Applications should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury. In the case of an injury arising out of an event which took place before the commencement of the Scheme, the application must be made not later than three months from the date of the commencement (subject, also, to the foregoing exception).
At 2.(f) of his Application the Applicant sets out "Since the incident I have suffered with a very serious head injury & have not been able to return to work. I suffer with severe headaches & terrible vertigo and have not been able to address or even think about the incident, it was so traumatic".
This Application was made outside of the 3 month time limit provided for by Article 21 of the scheme, and the grounds put forward by the applicant do not warrant exceptional treatment. In light of same I refuse the application.
