Scheme of Compensation for Personal Injuries Criminally Inflicted

This is an application for [ ] whose son [ ] was fatally wounded at [ ].
On the [ ] the deceased, who was at the time, a [ ] year old single man was [ ]. He was pronounced dead at the scene.
At the time of [ ] death he was unemployed and he had 47 criminal convictions ranging from theft, criminal damage and drug offences.
Article 14 states:-
"No compensation will be payable where the Tribunal is satisfied that the conduct of the victim, his or her character or way of life make it inappropriate that an award should be granted and the Tribunal may reduce the amount of an award where, in its opinion, it is appropriate to do so having regard to the conduct, character or way of life of the victim."
Having given the matter careful consideration the Tribunal is of the view that an award will be made in respect of the funeral expenses only in the sum of the amount claimed of €10,881 to be repaid to who met those costs.
