A personal representative is also known as the executor of a deceased person’s estate if they made a will or the administrator of their estate if they did not make a will.
If you wish to make an application on behalf of a deceased person who you believe spent time in a scheduled institution and died on or after 13 January 2021, you must be a personal representative.
You may be the beneficiary of a deceased person’s estate, but not the personal representative. Unfortunately, we cannot deal with a beneficiary unless you are also the personal representative.
In order to make an application to the Payment Scheme you need to provide a certified copy of the applicant’s death certificate and one of the following as proof that you are entitled to act as a personal representative:
(a) A Grant of Probate (certified copy) or
(b) A Letter of Administration (certified copy) or
(c) A certified copy of the will as there is a will but no Grant of Probate or
(d) An affidavit swearing that you are entitled to act as personal representative as there is no will, Letter of Administration or Grant of Probate.
If we receive any of the proofs at (a) to (d) above, we will allow an application to progress to Notice of Determination only. However, if you receive an offer, a Grant of Probate or a Letter of Administration will be required before any payment is made. This is to ensure full compliance with the Mother and Baby Institutions Payment Scheme Act 2023.
For administrative reasons, we cannot deal with more than one personal representative. So, where there is more than one personal representative acting on behalf of a deceased person, we request that one person is nominated, to deal with application. If this request cannot be facilitated, the application will proceed dealing with the first personal representative to come forward.
