Decision: Award of €210 to the applicant
On [ ] the applicant was driving his car into an estate when he heard a bang at the front of his car. The applicant got out of the car and approached three males, the injured party was struck in the face and sustained bruising to his left eye and face. The applicant got back in his car and drove home. He reported the matter to the gardaí at 22.00 hours. There were no witnesses to the incident and there is no CCTV. No criminal prosecution occurred.
I am satisfied on the balance of probabilities that the applicant sustained personal injury directly applicable to a crime of violence and accordingly I admit the application for consideration under the Scheme.
The applicant has submitted a receipt for €60 for a visit to his GP and a receipt for €150 for a dental visit.
The applicant has submitted out of pocket expenses in the sum of €210 for treatment received as a result of his receiving a blow to the face. I am satisfied that the applicant is entitled to be reimbursed this amount of money. While no criminal prosecution ensued the applicant reported the matter to the gardaí without delay.
