1. The applicant in his application form stated that an incident occurred [ ]. The applicant stated that he had no recollection of what happened on the night and that he had loss of memory. He stated that he only knows what he has been told, that he was assaulted around the head. The applicant outlined that he had a broken jaw, eye injury, cuts to the head and loss of memory as a result of the incident.
2. The application form is signed and dated [ ]. It was received by the tribunal on [ ]. The application form was sent in by a solicitor acting on the applicant's behalf. The tribunal acknowledged receipt of the application on [ ] and explained that documentary evidence would be required to claim out of pocket expenses. The tribunal received no reply to this letter.
3. On [ ] the tribunal wrote to the applicant's solicitor enquiring if the applicant wished to pursue the application and if so to forward any documentary evidence before [ ]. The tribunal has received no response to this letter and the matter has been forwarded for a decision.
4. No receipts have been submitted by the applicant. It is not possible in the circumstances to progress or consider the application any further.
5. Paragraph 11 of the Scheme provides that "no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise." It is my opinion that all reasonable assistance has not been provided in this matter. Furthermore, it is for the applicant to establish his case and that has not been done.
6. I make no award in respect of this application.
