Scheme of Compensation for Personal Injuries Criminally Inflicted

The Applicant was attacked by a large group of people on the [ ]. The Applicant was hit on the head with a [ ]. The perpetrator was prosecuted in respect of the assault, however the Applicant did not receive any compensation in respect of the assault. The matter was reported to An Garda Siochana.
The Applicant made an application to the Criminal Injuries Compensation Tribunal on the [ ]. Article 21 of the scheme states:
"Applications should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury. In the case of an injury arising out of an event which took place before the commencement of the Scheme, the application must be made not later than three months from the date of the commencement (subject, also, to the foregoing exception)".
No circumstances have been identified by the Applicant to justify exceptional treatment of the claim, so as to accept the claim to the Scheme outside the 3 month time limit. The claim was made almost two years after the incident.
In the circumstances the Tribunal does not accept the claim as it was made outside the permitted time limit. Therefore, no award is made.
