Scheme of Compensation for Personal Injuries Criminally Inflicted

This is an application for [ ] whose son, [ ], was fatally wounded in [ ].
The deceased who was a [ ] had been reported missing [ ] earlier and a Garda investigation commenced. His body was found with [ ] [ ]. The murder case is still under investigation and no proceedings have been taken to date.
At the time of [ ] death he was unemployed and he had 27 criminal convictions.
Article 14 of the scheme states:-
"No compensation will be payable where the Tribunal is satisfied that the conduct of the victim, his or her character or way of life make it inappropriate that an award should be granted and the Tribunal may reduce the amount of an award where, in its opinion, it is appropriate to do so having regard to the conduct, character or way of life of the victim."
In the circumstances the Tribunal is limiting the solatium award to €5,000 to [ ] [ ] together with the funeral expenses set out below, to be repaid to who paid them.
The overall award will be €13,354.
