Appeal of Mr. [ ] (the Appellant)

This is an appeal against a sole-member decision given on [ ] [ ], allowing the Appellant's Application but reducing his award by 50% having considered her conclusions regarding the application of Articles 13 and 14 of the General Scheme.
A three-member panel of the Tribunal having heard the appeal on [ ], having read and considered the papers circulated, having heard what was offered by Counsel for the Appellant and having heard the direct evidence of the Appellant and his mother, the Tribunal accepted that the Appellant was entirely blameless with regard to the vicious assault occasioned on him on [ ] by the same offender who had fatally assaulted his sister immediately prior to his assault, determined the appeal in favour of the Appellant pursuant to the General Scheme and made the following ex-gratia award in his favour in respect of the loss of earnings claimed.
Total award to be made: €14,945
