Scheme of Compensation for Personal Injuries Criminally Inflicted

The Applicant is the mother of the deceased. The Deceased received a stab wound to [ ] on the [ ] at approximately 7am. He was pronounced dead at [ ] at 7.36am. No proceedings were taken on foot of the matter. The Deceased had nine previous convictions dating from [ ] including 4 convictions for assault causing harm and 2 convictions for assault. Paragraph 21 of the Scheme provides:
"Applications should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury...."
The application was made outside the 3-month time limit under the Scheme, with no reasons proffered as to why the application justifies exceptional treatment. In the circumstances no award is made on the grounds that the application falls outside the time limits for making an application, and no exceptional circumstances were given so as to justify exceptional treatment.
