Application of [ ] in respect of [ ] Deceased
Case Number: F/50665
This application arises out of the death of [ ] who was shot to death on the [ ] in [ ].
In a letter dated the [ ] from An Garda Siochana I am advised as follows:
"I refer to the attached and wish to report the following. [ ] was a member of the [ ] criminal gang who are involved in the [ ] with a criminal gang led by [ ]. To date [ ] have been killed as a direct result of this ongoing feud".
As no effort has been made on behalf of the Applicant to contradict this statement I am led to conclude that Article 14 of the Scheme applies. Article 14 of the Scheme provides as follows;
"No compensation will be payable where the Tribunal is satisfied that the conduct of the victim, his character or his way of life make it inappropriate that he should be granted an award and the Tribunal may reduce the amount of an award where, in its opinion, it is appropriate to do so having regard to the conduct, character or way of life of the victim".
In the circumstances I decline this application.
