Decision: Award of €622.78
1. In his application form, the applicant states that on [ ] he was pulled from behind without warning or notice and kicked in the face by a person named by the applicant and another. The applicant states that the incident was witnessed by his girlfriend.
2. The applicant states that his left jaw and ribs were badly bruised as a result of the assault. The applicant required a dental x-ray and attended at [ ] Hospital, [ ] and his GP.
3. The matter was reported on [ ] to the gardaí by the applicant and there is a letter from a Superintendent to the applicant dated [ ] confirming that a crime had been reported and was under investigation.
4. I am satisfied on the balance of probabilities that the applicant in this matter suffered personal injury which was directly attributable to a crime of violence.
5. The applicant reported the matter to the gardaí shortly after it occurred and an investigating garda was assigned.
6. As a result of the incident the applicant attended [ ] Hospital, his own GP and his dentist. The applicant has submitted receipts for these visits in the sum of €255.
7. The applicant, at the time was working in a factory. He was out of work due to the incident from [ ] inclusive. There is a questionnaire on file from his employer which states that his net loss of earnings and overtime was €367.78.
8. I am satisfied that the applicant was assaulted by a person known to him and that the matter was reported to the gardaí. I am satisfied that he sustained injuries to his jaw and ribs and that he incurred the expenses and loss of earnings as set out at paragraphs 7 and 8 above. I make an award of €622.78.
