The Department of Health commissioned an Independent Review, in the context of a protected disclosure made in 2020, of allegations regarding, inter alia, practices relating to the gathering & sharing of information in the context of managing Special Education Needs (SEN) litigation.
The review, conducted by Senior Counsel Mr Conleth Bradley SC and with necessary, but limited redactions to protect personal and commercially sensitive information, legal privilege and other relevant matters, is available here:
Following the RTÉ broadcast of the 25th March 2021, The Department of Health set up a team to establish the facts in relation to the allegations made in the broadcast and associated articles published on the RTÉ news website. This team was supported by an external Documentary Counsel Review Team.
The review scope was focused on the 29 ‘open’ “SEN” cases where the Department of Health was named as a defendant and which have not come to a final conclusion (i.e. settled, determined by a court or discontinued by the plaintiff).
