Appeals

All applicants refused international protection have a right to appeal to the International Protection Appeals Tribunal (IPAT)a statutorily independent body, which must then consider if the International Protection Office (IPO) determinations should be upheld or overturned.

Where IPAT upholds a determination to refuse international protection, and if permission to remain has also been refused by the IPO, the applicant can then seek a formal permission to remain review by the Minister for Justice.

This will be considered in cases where a person’s circumstances may have changed in a material way since the initial decision was made to refuse permission to remain.
