Any EU country may use the European arrest warrant to seek the return of a person who is wanted in that country in relation to a crime. The warrant may seek the return of the person to:

  • stand trial
  • face sentencing after conviction
  • serve a sentence already handed down by a court in that country

Legislation

The European Arrest Warrant Act 2003 (as amended) contains all the provisions in relation to the European arrest warrant. The Act implements the provisions of the Council Framework Decision of 13 June 2002 on the European arrest warrant and the surrender procedures between Member States (2002/584/JHA).

The Act provides that the Central Authority (details below) in Ireland for the purpose of the European Arrest Warrant is the Minister for Justice.
