Support-Application


What is a support application?

A support application is one made on behalf of an applicant, where a formal arrangement is in place to act on their behalf. These applications are provided for under Section 36 of the Mother and Baby Institutions Payment Scheme Act 2023.

The formal arrangements are:

  • Decision-Making Representative appointed by the court under the Assisted Decision-Making (Capacity) Act 2015;
  • Ward of Court as the court appointed committee of the Ward;
  • Enduring Power of Attorney under the Powers of Attorney Act, 1996;
  • Enduring Power of Attorney under the Assisted Decision-Making (Capacity) Act 2015;
  • A similar legal arrangement from another state.

If you are applying to the Payment Scheme as a support person you will need to provide proof in respect of one of the above arrangements. Applications to the Payment Scheme will not be accepted by a person acting on behalf of an applicant in any circumstance other than those outlined above.
