Circular Letter reference NRUP 07/2022 (available to view below) issued on 21st December 2022, sets out advice and provides an update on the following three matters:
Part A:
Advises of the commencement on 4thNovember 2022, of sections 2, 8 and 9 of the Planning and Development, Maritime and Valuation (Amendment) Act 2022, applying minor technical amendments to the Act, further to the enactment of the Planning and Development, Maritime and Valuation (Amendment) Act 2022.
Part B:
Advises of the amendment of the Section 28 Sustainable Urban Housing - Design Standards for New Apartments Guidelines which removes the distinct status of Build to Rent (BTR) developments in the planning system. This amendment will mean that there will no longer be a difference in standards for future apartment developments, regardless of the development type. All apartment developments shall now adhere to the same standards. The amendment takes effect, as of and from, 22nd December 2022. A copy of these amended Guidelines are available to view below.
Part C
Advises planning authorities who are in the process of considering any submissions requesting a change to statutory land use zonings, as facilitated under Section 653I(1)(a) and (b) of the Taxes Consolidation Act 1997 (as amended).
