1. The applicant was attacked in a bar with a bottle. The applicant received an injury to his lip that required plastic surgery. The perpetrator of the assault was prosecuted and received [ ] sentence [ ]. The perpetrator paid over €5,000 in compensation to the applicant as part of the court case.
2. At the time of the garda report there was a live bench warrant in existence for the applicant for failing to turn up in court in connection with an assault charge against his partner.
3. The tribunal wrote to the applicant’s solicitor on [ ] and received no response to that letter.
4. The tribunal wrote to the applicant’s solicitor on [ ] asking if the applicant was pursuing his claim and no response was received.
5. Paragraph 11 of the Scheme provides “no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise.”
6. The tribunal has had no contact from the applicant or his solicitor since [ ]. It is for an applicant to establish his case and that has not been done in this claim. No receipts for out of pocket expenses have been submitted. I am of the opinion that all reasonable assistance has not been provided and I make no award.
