In the early hours of the [ ] the Applicant and a friend attended a chippers after going to a nightclub in [ ] town. After leaving the chipper the Applicant heard somebody shout “[ ]”. The Applicant started running towards the Garda Station and after that he blacked out. When the Applicant came to he saw a number of unfamiliar faces around him and he put his hand to the back of his head and when he brought his hand back around he could see there was blood on it. The next morning the Applicant attended a doctor who gave him some painkillers and prescriptions for eyedrops. The doctor checked his left ear as everything sounded muffled in his left ear. Later that day he became unwell and his parents brought him to [ ] Hospital for a check-up.
At the hospital he was kept in overnight and they did a CT scan on him. The Applicant submitted that as a result of the incident he cannot hear properly from his left ear. The Applicant submitted:
On the [ ] the Tribunal wrote to the Applicant and requested a copy of his P60 for the preceding year and a statement from the Department of Social Protection showing the number of weeks in which benefit was paid as a result of the injuries. On the [ ] the Applicant was asked whether he intended on continuing with his application and further on the [ ] the Applicant was asked to respond to previous correspondence and informed that the file was to be sent to a Tribunal member for a decision on the [ ] if no response was received. The receipts submitted by the Applicant amount to €550.62. In circumstances where the Applicant has submitted a Garda report in respect of the incident and receipts in respect of medical treatment received the Tribunal awards €550.62 to the Applicant in respect of the incident.
