1. The applicant was the victim of an unprovoked attack while attending a concert in [ ]. He was stabbed multiple times with [ ].
2. The gardai have provided a report in this matter. The perpetrators of the assault on the applicant were prosecuted before the [ ] Court and received custodial sentences.
3. A report dated [ ] from the [ ] Hospital is on file and outlines the injuries sustained by the applicant.
4. The tribunal wrote to the applicant and acknowledged receipt of the application on [ ].
5. On [ ] the tribunal wrote to the applicant and requested details of the applicant’s out of pocket expenses and loss of earnings. The tribunal did not receive a reply to this letter.
6. On [ ] the tribunal wrote to the applicant asking if he wished to pursue his claim. The tribunal did not receive a response to this letter.
7. Paragraph 11 of the Scheme provides that “no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise.”
8. The applicant has failed to engage with the tribunal in relation to his claim. Necessary documentation associated with the claim has not been submitted as requested. I am of the opinion that all reasonable assistance has not been provided to the tribunal in relation to this application. It is for the applicant to establish his case and that has not been done. I make no award.
