Decision outcome: The application is refused under Article 9 of the Scheme.
1. Mr [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. His application for compensation under the Scheme is in respect of an incident which happened on the [ ] at 12.30am near [ ].
At around midnight on that particular night a group of about ten friends and the Applicant were walking from [ ] to a house party in [ ]. The Applicant says that he was approached by four or five guys who prevented himself and his companion from passing. They verbally abused him and told him to fuck off. As he tried to get past them he was attacked.
He received several blows to the head and face which left him dazed and unable to see. He said it all happened very fast. He recalls trying to shield his head with his arms and attempted to get away. He was stunned and shocked. He attended [ ] Hospital as he received an injury to his forehead necessitating eight stitches. He reported the matter to An Garda Siochana on the [ ].
He was brought around the area by an Garda Siochana to try and locate the exact scene of the crime but was unable to do so. A statement was also taken from his companion [ ]. She was also unable to give an exact location of the incident. The Applicant submitted an invoice for €66.00 in respect of his attendance at [ ] Hospital with his application form. The Secretary to the Tribunal wrote on the [ ] seeking full particulars from An Garda Siochana which were supplied.
There is a note to the effect dated the [ ] that the Applicant is to send in receipts for dental expenses. He has submitted no receipt for medication and has no further expenses as a result of the incident.
3. Article 9 of the scheme provides “no compensation will be payable unless the Tribunal is satisfied that the injury is such that compensation of not less than €500.00 should be awarded”.
The Applicant has submitted an invoice in respect of special damages in the sum of €66.00. No further invoice has been submitted.
The Applicant is resident in [ ]. He was written to on the [ ] and asked to provide a number of items of documentation including original receipts and vouching documentation regarding out of pocket expenses. He was also forwarded a copy of the Garda Report. To date nothing further has been heard from him.
4. The Applicant has not meet the requirements of Article 9 of the scheme and accordingly the application must be dismissed.
