The Applicant submitted that on the [ ] between 1am and 2am after socialising, he was followed by two males and two females who started to punch and kick him as he walked along. He was eventually pushed to the ground the four people continued to attack him. The Garda report in respect of the incident indicates that the Applicant did not wish to make a complaint to the Gardaí who attended at the hospital in respect of the incident. Article 23 of the Scheme provides “to qualify for compensation it will be necessary to indicate to the Tribunal that the events giving rise to the injury had been the subject of criminal proceedings or that it was reported to the Gardaí without delay”. In the instant case the Applicant has not cooperated with the Gardaí and therefore no compensation is awarded in respect of the claim.
