On the [ ] the Applicant was stabbed in an unprovoked attack while walking with a friend. The Applicant submitted that he was jumped on from behind and stabbed seven times in and around the head, neck, back and shoulders. The Applicant was seriously injured, and an ambulance was called, he was taken to hospital where he received a blood transfusion and was put on life support in intensive care for 24 hours. The Applicant was in intensive care for eight days as a result of the incident and two days thereafter on an ordinary ward. The assailant was charged and sentenced to [ ]. The Applicant submitted that he was earning €200 per week prior to the incident and that he was absent from work from the [ ] to the [ ]. The Applicant submitted in his application form that he was seeking compensation for pain and suffering. The Applicant submitted the reason the application form was late was because he did not know of the three-month time limit in respect of the Scheme. The Applicant submitted that he was informed that he had to wait until the court case was over before making a claim which is why the application was late. The Tribunal finds that there are circumstances such as to justify extending the time for the Applicant’s application to the Scheme. However, in circumstances where the Applicant has not submitted any vouchers, receipts or documentation evidencing special damages arising as a result of the incident the Tribunal makes no award. On the [ ] the Tribunal wrote to the Applicant and informed him that if they did not hear from him by the [ ] the file was to be sent to a member for a decision. The Tribunal did not receive any response to that correspondence.
