Decision outcome: The applicant is awarded the sum of €1,700 under the Scheme.
1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. In his application for compensation under the Scheme, dated [ ], the applicant stated that he had suffered injuries on [ ] when he was attacked by a group of youths armed with bottles while walking home. The applicant states that he suffered a lacerated left ear, bruising and shock.
3. The application was made within time, and it is clear from the Garda Report on file that the applicant sustained serious injuries as a result of a crime of violence.
4. From the foregoing, I am satisfied that the applicant has established, on the balance of probabilities, that he was a victim of a crime of violence and sustained personal injury which is directly attributable to that crime of violence. Accordingly, I admit the application for consideration under the Scheme.
5. The applicant stated in his application form that his injuries were to his face and ear, and that he had one night as an inpatient in respect of the assault. He said that in the course of the assault his hearing aid was smashed and he required a new one.
6. The applicant submitted an invoice for his hearing aid dated [ ] in the sum of €1,700. This hearing aid was required to facilitate the applicant hear, and its necessity arose as a direct result of the incident: it is treatment or health related. The item is allowed in full.
7. On [ ] the Tribunal Secretariat wrote to the applicant. This letter asked, among other things, that the applicant incurred any further expenses or if the cost of the hearing was full extent of the claim. There was no reply to this letter.
8. A further letter of [ ] enclosed the earlier letter of [ ] and asked the applicant if he wished to pursue the application. The Tribunal Secretariat received no response to this letter.
9. As such, it appears that the extent of the applicant’s claim is the €1,700 for his hearing aid, which is awarded to him in full.
