Decision outcome: €812.18.
1. [ ] (‘the Applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. In her application for compensation under the Scheme, the Applicant complains of personal injuries criminally inflicted by way of an incident which occurred on the [ ]. The circumstances of the incident are outlined by the Applicant in her application to this Tribunal and by the report of An Garda Siochana.
3. The Applicant describes as an unprovoked assault which occurred at [ ] which resulted in the Applicant receiving facial/mouth injuries. As a result of these injuries the Applicant was required to attend at the A&E Department of [ ] Hospital [ ] and also with [ ] Dental Practice.
I am satisfied that the Applicant has established that she was a victim of a crime of violence and sustained personal injury which is directly attributable to that crime of violence. Accordingly, I admit the application for consideration under the Scheme.
5. The Applicant submits vouchers in respect of her out of pocket expenditure as follows:
a) [ ] Dental Surgery - €540
b) [ ] Hospital - €175
In addition the applicant also claims out of pocket expenditure in respect of travel/taxis in the sum of €32; Prescriptions €9.18; and makeup to cover her injures in the sum of €56.
I am satisfied that all of the above expenditure was reasonably incurred by the applicant as a result of her injuries and accordingly I award the sum of €812.18.
6. The Applicant has not submitted any claim in respect of loss of earnings and therefore the total award in this case is €812.18.
