1. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The Applicant states that he was in attendance at the [ ] on the evening of the [ ] into the morning of the [ ] ([ ]) where he was struck with a bottle by a known assailant while on the balcony area of the [ ] Bar.
3. The Applicant states that as a result of the incident he suffered a scar to his forehead area. He attended Dr. [ ]. It is noted that this application was received by this Tribunal in respect of the incident on the [ ]. No further documentation appears by way of application and in particular no vouchers in respect of special damages has been submitted.
4. It is also noted that this application was submitted significantly outside the three month period allowed for the making of such applications. For the purpose of completeness paragraph 21 of the relevant Scheme, now paragraph 20, “requires application to be made as soon as possible but except in circumstances determined by the Tribunal to justify exceptional treatment no later than three months after the date of the event giving rise to this injury”.
5. It is further noted the Criminal Injuries Compensation Tribunal on [ ] wrote to the Applicant’s legal representatives requesting that they furnish vouching documentation to include original receipts and documentation in relation to out of pocket expenses. No response was received as required by the [ ].
6. Finally it is noted that on the [ ] the Tribunal had previously requested particulars from the Applicant’s legal representatives and again no response was received to this correspondence.
7. In circumstances whereby the application was submitted outside the three month period and no explanation has been provided for same combined with the Applicant having submitted no vouching documentation this application is dismissed.
8. No award is made.
