On the [ ] the Applicant was leaving a nightclub at the [ ] when he was attacked and assaulted. The Applicant suffered severe head and face wounds and required 12 staples in his head. The Applicant attended [ ] Hospital and was later referred on to [ ] Hospital to consult the Plastic Surgery Unit in relation to the wound on his face. The Applicant required inpatient treatment from the [ ] to the [ ] The Applicant submitted that he was earning €2,100 per month but that as a result of the incident he lost his job. The Applicant submitted that he lost approximately €3,500 as he returned to employment on the [ ]. The Applicant submitted that he had received disability pay and a medical card for four weeks after the incident. The Garda report dated the [ ] states that on the night in question the Applicant did not wish to make a complaint in relation to the alleged incident and subsequently made a complaint on the [ ] at [ ] Garda Station. By letter dated the [ ] the Tribunal wrote to the Applicant and informed the Applicant that all claims must be supported with documentary evidence. On the [ ] the Tribunal requested further information from the Applicant including his net loss of earnings during the period and inquired whether he was entitled to sick pay during his absence from work. By letter dated the [ ] the Tribunal wrote to the Applicant and asked that he furnish all documents to the Tribunal by the [ ] as thereafter the file would be sent to a Tribunal member for a decision. No documents were received from the Applicant in respect of his earnings at the time of the incident or the sum of disability pay received by the Applicant after the incident. In the absence of having received any vouching documentation in respect of the claim the Tribunal makes no award in this instance.
