On the [ ] the Applicant was hit by a boy also attending [ ] College in [ ]. The Applicant was hit in the right eye as a result of which he fell to the floor. The Applicant was concussed and was vomiting as a result of the incident, and he was brought to [ ] Hospital where he was transferred by ambulance to the [ ] Hospital in [ ]. After a week of vomiting and concussion the Applicant had surgery for a fracture to his right eye socket, the surgery had to be repeated in [ ], however as a result of the incident the Applicant’s eye muscle was damaged and he has permanent double vision in that eye. The Applicant was [ ] years old at the date of the incident. As a result of the incident the Applicant has been required to attend [ ] Hospital in [ ] and Mr. [ ] Plastic Surgeon in the [ ] Hospital in [ ]. All hospital treatment received by the Applicant was covered by the VHI. By letter dated the [ ] the Applicant was requested to submit all documentary evidence in respect of the claim. By letter dated the [ ] the Applicant was requested to submit any documentary evidence in respect of expenses incurred as a result of the incident. By letter dated the [ ] the Applicant was requested to submit any documents he wished to rely on by the [ ] as the file would be sent to a Tribunal member for a decision thereafter. While the Applicant received a serious personal injury as the result of a criminal act no documentary evidence or vouchers or receipts were received from the Applicant in respect of losses incurred as a result of the incident. In the circumstances the Tribunal makes no award.
