Decision: No award.
1. The applicant, in her application form, states that she received a gun shot wound to [ ] by a named offender at her home address on [ ]. The application form that was sent in to the tribunal was incomplete and a necessary authorisation was unsigned and undated.
2. The tribunal wrote to the applicant on [ ] requesting inter alia that she complete the application form in full. The tribunal had no contact from the applicant until she sent an email to the tribunal on [ ] stating that the court case was finished and that she had no more information to send in.
3. The tribunal responded to the applicant by letter dated [ ]. The tribunal pointed out that the completed application form had not been sent in and the necessary authority had not been provided for the tribunal to advance the application.
4. By email dated [ ] the applicant informed the tribunal that she had no out of pocket expenses as she had a medical card. The tribunal responded by explaining that the Scheme does not allow for payment of general damages and that only out of pocket expenses are covered.
5. There has been no further communication from the applicant.
6. Paragraph 11 of the Scheme provides “no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise.”
7. The applicant has not provided a properly completed application form in this matter and it is my opinion that she has not provided all reasonable assistance to the tribunal. Further, it appears from her email communication that she has no out of pocket expenses arising from the incident. In the circumstances I make no award.
