1. Mr. [ ] ('the Applicant') has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted ('the Scheme').
2. The application form in this matter was received from the Applicant's Solicitors on the [ ]. The application arises pursuant to an incident which occurred at [ ]. The Applicant states that he suffered a stabbing to his [ ] cheek. He attended the A&E Department of [ ] Hospital and later at [ ] Hospital [ ].
3. The Applicant states at page 10 of his application form that civil proceedings were being contemplated against the alleged Offender at the date of application.
4. The Applicant confirmed that he was self-employed and he submitted copies of his revenue returns for the applicable period.
5. The Applicant states that as a result of this assault he lost vision in his [ ] eye and his vision has been severely affected since the date of the incident. He also states that he is not eligible for illness benefit as he is self-employed.
6. The Applicant states that Garda [ ] of [ ] Garda Station was the investigating garda.
7. The Tribunal acknowledged receipt of the application on [ ], and requested the provision of original receipts and a Statement from the Department of Social Protection. Further Revenue documentation was provided to the Tribunal by way of letter from the Applicant's Solicitors on the [ ]. The Tribunal responded thereto on the [ ], requesting original medical receipts and a statement of claim in relation to loss of income. The said Solicitors responded by way of correspondence dated the [ ], seeking to clarify what the Tribunal were referring to when they referred to a statement of claim in respect of loss of income. They also confirmed that the Applicant had no medical receipts to submit.
8. The Tribunal responded by letter dated the [ ], asking whether the Applicant was in receipt of Social Welfare payments during his absence from work and asking the said solicitors to confirm whether the Applicant had returned to work and if so, the date of his return.
9. It does not appear that a response was received to that correspondence. On the [ ] email correspondence issued from the Tribunal. Further email correspondence followed from the Tribunal on the [ ]. A response was received from the said solicitors by email dated the [ ], stating that they wished to receive a copy of the said correspondence issued by the Tribunal on the [ ]. That correspondence was provided to the said solicitors by the Tribunal on the [ ]. No further correspondence appears on file. No further correspondence appears on this file.
10. In the absence of the provision of sufficient information by the Applicant at this time it is not open to the Tribunal to make an award. No award is made pursuant to paragraph 10 (previously 11) of the Scheme.
