1. Mr. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The incident in question occurred at [ ] Nightclub, [ ] at approx. [ ] on the morning of the [ ]. The Applicant describes an incident whereby he was in attendance at the said nightclub on [ ] when he was assaulted by a fellow nightclub attendee.
3. The incident was reported to [ ] Garda Station. The Applicant suffered a broken jaw, a fractured eye socket and nose. The Applicant describes having required hospital and dental treatment. The Applicant states in his application form what he has incurred dental expenditure in the sum of €270 together with expenditure in respect of medical and travel expenses.
4. Paragraph 21 of the relevant Scheme, now paragraph 20, “requires application to be made as soon as possible but except in circumstances determined by the Tribunal to justify exceptional treatment no later than three months after the date of the event giving rise to this injury”. The application in this instance was submitted outside the three-month period and no explanation has been provided by the Applicant as to the lateness of same.
5. It is also noted that the Criminal Injuries Compensation Tribunal wrote to the Applicant on the [ ] requesting that he furnish vouching documentation which would be required in support of his application to include original receipts and documentation in relation to out of pocket expenses. No response was received as required by the [ ].
6. In circumstances whereby no vouching documentation has been received - combined with the fact that the application was submitted outside a three month period with no explanation provided by the Applicant - this application must be dismissed.
7. No award is made.
