To accept an offer from the Payment Scheme, you must return a signed and dated acceptance form and legal waiver.
On the portal, please take the following steps:
1. Download (print off) your Notice of Determination (NOD).
2. Sign and date the Acceptance Form and Legal Waiver at the end of the NOD.
3. Complete the banking details form if you have not provided these details already (or if you wish to change the details you have already provided).
4. Complete by uploading these (acceptance, legal waiver and bank details) back to the portal using the ‘+ Add Files’ button and clicking ‘Submit’.
To accept an offer by post, please sign and date the paper acceptance form and legal waiver and complete the bank details form, if you have not provided these details already, and post it back to us at PO Box 13668, Waterford, Ireland
There is capped financial support available to applicants to the Payment Scheme who wish to obtain independent legal advice prior to accepting an offer and signing the legal waiver.
All payments from the Payment Scheme must be made to an account in the name of the applicant, with the exception of arrangements that may be in place for support or estate applications. We can make a payment to any account that has an IBAN** and can accept a payment transfer. This includes accounts across a range of financial institutions such as banks, credit unions or An Post.
If you intend to make an application to the Payment Scheme and do not have a bank account in your own name, the Payment Scheme Office would advise that you make arrangements to open an account in your own name while your application is being processed. In the majority of cases, we only require bank details at the end of the process when it has been determined that an applicant is entitled to benefits under the scheme.
If you have made an application to the Payment Scheme and provided bank account details for an account not in your own name, the Payment Scheme Office will get in touch with you.
**IBAN stands for International Bank Account Number and is a is a standard international numbering system for individual bank accounts around the world.
Once you have returned your signed acceptance form and legal waiver, a number of important final checks will be made in the Payment Scheme Office to ensure that everything is in order. You should receive your payment within 4-6 weeks of receiving your ‘acknowledgement of acceptance’ letter.
If you live in Ireland, the financial payments from the Payment Scheme are:
• exempt for the purpose of income tax, and
• disregarded (i.e. not taken into account)
o in relation to the Fair Deal Scheme (for those in long term nursing home care);
o in the means test for social welfare payments;
o in the means test for the general medical card;
o in calculations relating to residential care services for people with disabilities;
o as reckonable income in the Student Grant Scheme (SUSI).
