1. Mr. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The application arises as a result of an incident which occurred at 1.15 a.m. on the [ ]. On this application form to this Tribunal the Applicant states that on the [ ] at 1.30 a.m. at [ ] he was in a vehicle with his work colleagues at traffic lights at the [ ] Hotel when he was approached by a male who walked out in front of the vehicle. The Applicant stopped his vehicle, exited same. The male who had previously been standing in front of the car and kicking the car then threw a full can of beer at the Applicant hitting him.
3. The male in question and a second male started punching and kicking the Applicant whose friend came to his assistance and took him back into the car. Following the assault, the Applicant went home and was later treated for his injuries, in particular an injury to his left eye, at [ ]. He was transferred via ambulance to the [ ]. The Applicant required a number of operations on his left eye. The matter was reported to An Garda Siochana. The D.P.P. directed a prosecution in relation to the matter and An Garda Siochana confirm that no compensation was paid by the offender.
4. In this application form the Applicant outlines a claim for out of pocket expenditure. He also states that he is making a claim for loss of earnings.
5. On the [ ] the Applicant was issued with correspondence from this Tribunal who requested that he provide details of his loss of earnings and a P60 for the previous year. No documentation was submitted in response to this correspondence. Further no explanation has been provided by the Applicant as to why the application was submitted outside the three month period required for the making of such applications.
6. On the [ ] the Applicant was reminded that he was to furnish documentary evidence to the Criminal Injuries Compensation Tribunal of out of pocket expenditure. No reply was received from the Applicant.
7. On the [ ] the Tribunal again wrote to the Applicant requesting that he furnish the documentation required no later than the [ ]. No response was received to this correspondence.
8. It is apparent therefore that the Applicant has failed to prosecute his claim and submit the required documentation to this Tribunal in particular in respect of his claim for loss of earnings and out of pocket expenses. It is also apparent that this claim was submitted outside the three month period allowed for the making of applications and no explanation has been provided in this regard.
9. In these circumstances this application is dismissed and no award is made.
