1. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The incident in question occurred on the [ ] at [ ]. The Applicant reported the matter to [ ] Garda Station and An Garda Siochana report that the Applicant was a victim of a violent assault in a nightclub at approx. 12 a.m. on the [ ]. The report states that the Applicant was punched with a closed fist and was subjected to a repeat attack while exiting the premises sustaining dental injuries and bleeding to his nose, lip and gums.
3. The Applicant also reports bad bruising to the head, neck, back, arm and face areas. The Applicant was treated for his injuries in [ ] Hospital. He also attended Dr. [ ] who is presumably the Applicant’s G.P.
4. The Applicant has submitted a claim for dental expenses in the sum of €3,100. Correspondence has been received from [ ] Dental Practice advising that the cost of repairs to the Applicant’s teeth amounts to the sum of €350 per tooth. They report that approximate cost of same is increased by the potential necessity for the Applicant’s teeth to be crowned. It is noted the cost of a crown in each case is €2,000. They also note a fee in respect of restoration of the upper teeth at the cost of €80 per tooth.
5. A voucher has been submitted dated the [ ] from Dr. [ ] presumably in respect of a G.P. attendance.
6. While it is apparent that the Applicant in this case suffered injury and that injury was reported immediately to An Garda Siochana unfortunately it is not the case that the Applicant has submitted sufficient vouching documentation such as would support a claim for special damages.
7. No actual vouched expenditure has been submitted in respect of the Applicants dental injuries. It is specifically noted that the sole voucher in respect of expenditure incurred has been submitted from Dr. [ ] in the sum of €40.
8. It is apparent in this case that the Applicant has failed to furnish the Tribunal with any updated particulars of claim in particular vouching documentation.
9. It is noted that no communication has been received from the Applicant in respect of this matter since [ ]. In particular correspondence issued from the Criminal Injuries Compensation Tribunal dated the [ ] requesting that the Applicant forward original receipts and vouching documentation and I note no response was received to that correspondence, which required a response by the [ ].
10. In these circumstances considering the sole voucher which appears on the file is in the sum of €40 no award can be made in this case and therefore the application is dismissed.
