On the [ ] the Applicant was assaulted while out for a walk with his wife by three youths. The Applicant was kicked and punched by the youths and suffered injuries to his knees and head. The Applicant submitted that he also suffered a knife wound in the incident although no knife was recovered at the scene. Three youths were arrested in relation to the incident.
The Applicant submitted a receipt in the sum of €245 for [ ] Clinics; an invoice in the sum of €100 in respect of the Accident & Emergency Department at [ ] Hospital; a receipt in the sum of €100 for physiotherapy; and a prescription claim form in the sum of €24.57. The Applicant submitted a letter from his employer which stated that the Applicant lost €650 in having to replace himself for his job as he was injured on the day in question and could not carry out his duties. The Applicant submitted that he had incurred 72 miles in travel expenses however no vouchers were submitted to support the travel expenses.
The Tribunal finds that the Applicant was assaulted and submitted an application to the Tribunal within the time limit allowed for under the Scheme. In the circumstances the Tribunal awards €1,119.57 for vouched expenses together with €50 for estimated travel expenses totalling €1,169.57 for special damages incurred by the Applicant as a result of the injuries suffered from the assault. The Tribunal is not empowered to award general damages in respect of the injuries suffered.
