1. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The incident in question occurred on the [ ] at [ ] Centre, [ ]. An application form was received duly completed by the Criminal Injuries Compensation Tribunal on the [ ].
3. The incident in question concerns an assault and robbery which took place at the supermarket. The matter was reported to [ ] Garda Station. It is noted that the assault appears to have been perpetrated upon the Applicant for the purpose of stealing the Applicant’s purse which she noted was missing from her handbag post the assault. The Applicant contacted security at the store in question however she was advised the incident was not captured on CCTV.
4. No vouchers in respect of special damages have been submitted in this case.
5. It is also expressly noted that this application was submitted outside the three-month timeframe allowed pursuant to paragraph 21 of the scheme for the making of such applications.
6. For the purpose of completeness paragraph 21 of the relevant scheme, (now paragraph 20), “requires application to be made as soon as possible but except in circumstances determined by the Tribunal to justify exceptional treatment no later than three months after the date of the event giving rise to this injury”.
7. The application in his case was submitted outside the three-month period and no explanation has been provided by the Applicant for the delayed application. It is also the case that no vouchers in respect of out of pocket expenses have been submitted and therefore no claim can be maintained.
8. In these circumstances the application is not admitted for consideration under the terms of the Scheme and no award is made.
