On the [ ] the Applicant was walking along [ ] Street in [ ] trying to get a taxi when he was assaulted by two youths. One of them hit him in the face fracturing his jaw in two places. After the assault the two assailants ran away. The Applicant was required to attend at [ ] Hospital where he received inpatient treatment from the [ ] to the [ ] and outpatient treatment from the [ ] to the [ ]. The Applicant was also required to attend at his GP in [ ]. As a result of the incident the Applicant submits he has a permanently swollen jaw and metal plates inserted in his jaw The Applicant submitted that he was earning €373.44 per week and estimates his total loss of earnings as a result of the incident at €1,120.32. The Applicant submitted that he was in receipt of disability benefit as a result of the incident, and that he also has a medical card. The Applicant submitted a statement from the Department of Social Welfare which shows that the Applicant received €1,283.60 from the [ ] to the [ ]. The Applicant submitted a letter from his employer indicating that he had lost €1,168.88 between the [ ] to the [ ] as a result of the incident. The Tribunal wrote to the Applicant on several occasions and most recently on the [ ] requesting that the Applicant furnish any further documents that he wished the Tribunal to consider. No response was received to the correspondence sent to the Applicant in respect of his claim. In circumstances where the Applicant received more in social welfare than he lost in loss of earnings as a result of the incident the Tribunal makes no award in this matter.
