1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. On the [ ], the applicant was viciously assaulted by three males (“offenders”) after refusing to [ ].
3. The matter was reported to [ ] Garda Station. The offenders were prosecuted.
4. The applicant has not provided the Tribunal with any medical report, but he has provided some medical records and a GP certificate. The applicant received an injury to his leg. He was treated in [ ] Hospital and subsequently he attended the fracture clinic in [ ] Hospital for his injuries.
5. The applicant, at the time, was s a part-time [ ] and a student. He was unable to work until the [ ] and [ ]. He has vouched this loss in the sum of €350. The applicant also incurred an A&E charge of €100 and a medication charge of €6.30. The applicant did not receive any social welfare.
6. The Tribunal has no doubt that the applicant was the victim of a vicious, unprovoked assault. Further, the Tribunal has no doubt that the applicant sustained significant physical and psychological injuries that will no doubt continue to have a profound and indefinite effect on him. If the Tribunal had the power to award damages for pain and suffering, the applicant would be a most and wholly deserving candidate. Unfortunately, it is not within the remit of the Tribunal to award compensation for pain and suffering. The Tribunal can only make an award in respect of vouched out-of-pocket expenses.
7. The applicant has put forward total out of pocket expenses in the sum of €456.30. The Tribunal makes an award for this amount.
